The Second Circuit was even in rulings on decertification motions, granting two and
denying two.
The Ninth and Eleventh Circuit each issued two rulings granting defendants’ motions to
decertify the collective actions and one motion rejecting the defendants’ attempt to
decertify.
The Fifth Circuit and Tenth Circuit granted all decertification motions it ruled on, for a
total of three.
Finally, the Third, Sixth, Seventh, and Eighth Circuits denied all defendants’ motions for
decertification.
