In 2022, there were over 450 privacy class action lawsuits filed in federal courts across
the country. Below is a chart showing states where privacy class actions were most
prolific – with California at the top.
Not surprisingly, Illinois and New York finished second and third. These locations tend
to be breeding grounds for class actions generally, and privacy class actions in
particular.
In 2022, rulings referencing the BIPA were noted 99 times, 93 in federal court and six in
state court. This is an increase from the numbers seen in 2021, when the BIPA was
only referenced 74 times.
