As in FY 2020, the EEOC reported in this year’s Agency Financial Report that the
Commission again filed 13 systemic cases, the same total as FY 2020, and down from
17 in FY 2019 and 37 in FY 2018.
The issues in those lawsuits involved challenges to employment policies that limit the
rights of individuals with disabilities, sex-based failures to hire, harassment based on
sex and pregnancy, discharges based on race and national origin, and age-based
layoffs.
Systemic lawsuits – 29 pending cases – accounted for 16% of the EEOC’s docket of
cases in FY 2022.
In contrast, by the end of FY 2018, the EEOC had 71 systemic cases on its active
docket, two of which included over 1,000 victims. Systemic cases accounted for 23.5%
of all active merits lawsuits in that year.
In delivering on its strategic initiatives, the EEOC secured $485 million in monetary relief
for over 15,000 alleged victims of employment discrimination in FY 2022. It resolved a
total of 138 merit lawsuits and reduced the inventory of its appellate cases by 9.1%.
In terms of systemic cases, the EEOC resolved 26 systemic lawsuits – four of which
included over 100 victims of discrimination each – and obtained $22.7 million in relief for
over 1,600 victims of alleged systemic discrimination.
Comparing the monetary recovery to previous years, the EEOC recovered $535.5
million in all types of cases in FY 2020, $486 million in FY 2019, and $505 million in FY
2018.
II.
Key Rulings In Government Enforcement Litigation
In 2022, there were 83 rulings filed across the country in cases brought by the EEOC.
The states with the highest numbers of decisions issued were Florida with eight,
followed by California and New York with six each.
