the Director of Human Resources if convicted of a violation of a criminal drug statute,
within five (5) days of conviction.
17. DOT Regulations. Any employees covered by the Department of Transportation’s
(DOT’s) Procedures for Transportation Workplace Drug Testing Programs (49 CFR Part 40),
are expected to maintain compliance with these regulations, which may differ from, or be
greater than, the requirements of this policy. Likewise, the Office of Catholic Schools will
maintain compliance with DOT federal regulations or other laws where applicable.
18. Subcontractors. Subcontractors employed by the Office of Catholic Schools to teach or to
perform other work may be required to observe the same safety regulations and may be
required to observe the same drug-free workplace standards as are all school employees.
All subcontractors may also be required to provide evidence of drug and alcohol testing
policies and procedures in compliance with the Georgia Workers’ Compensation Drug-Free
Workplace law and the Federal Drug-Free Workplace Act. In addition, all subcontractors’
employees may be subject to drug/alcohol testing when working at any Archdiocesan
school.
19. No Contract. This Drug-Free Workplace Program creates a policy on substance abuse. It
does not create a contract for employment or super cede any contract that exists.
20. Policy Changes. The Office of Catholic Schools reserves the right to change, alter, or
amend this policy at any time at its discretion.
21. Definitions. When used in this policy, the term:

“Alcohol” means ethyl alcohol, hydrated oxide of ethyl, or spirits of wine, from
whatever source or by whatever process produced.
“Drug” means amphetamines, cannabinoids, cocaine, phencyclidine (PCP),
methadone, methaqualone, opiates, barbiturates, benzodiazepines, propoxphene,
MDMA or a metabolite of any such substances. An employer may test an
individual for any or all of these.
“Employee” means any person who works for salary, wages, or other remuneration
for Archdiocesan schools and specifically includes faculty, staff, administrators on a
full or part-time basis as designated by the Office of Catholic Schools.
“Job applicant” means a person who has applied for a position within an
Archdiocesan school and has been offered employment conditioned upon
successfully passing a substance abuse test and may have begun work pending the
results of the substance abuse test.
“Nonprescription medication” means a drug or medication authorized pursuant to
federal or state law for general distribution and use without a prescription in the
treatment of human disease, ailments or injuries.
“Prescription medication” means a drug or medication lawfully prescribed by a
physician for an individual and taken in accordance with such prescription.
“Reasonable suspicion testing” means substance abuse testing based on a belief
that an employee is using or has used drugs or alcohol in violation of the
