Sub-consultant Agreement
A Sub-consultant Agreement is a suitable basis where:
•• a consultant wishes or perhaps is required by the client to appoint another
consultant (thus, a sub-consultant) to perform part of the consultant’s services,
and
• the contract terms are compatible with the (head) agreement between the
consultant and the client, with the complexity of the project and the risks to
each party.
The agreement is not for use where the client appoints consultants or specialists
directly.
The appointment of a sub-consultant may arise where the first consultant is
unable, for whatever reason, to perform part of the services under the head
agreement with the client, or where the client has appointed the consultant as
the sole consultant responsible for the whole of the design and management
process – a ‘one stop shop’.
A Sub-consultant Agreement will comprise:
•• the Sub-consultant Conditions of Appointment
•• Sub-consultant Agreement 2010: Notes: Part 1 Use and Completion; Part 2
Model Letter (2012 revision)
• Fees and Expenses Schedule 2010 (2012 revision).
For further advice refer to Guide to RIBA Agreements 2010 (2012 revision).
