Whilst nuptial agreements require disclosure about
potential
future
wealth,
actually,
there
is
no
obligation on the financially stronger party to push for
detailed information about their inheritance prospects
if that is not for thcoming from the older generation.
The financially stronger party is obliged to include details
in the agreement about what they know about their future
prospects.
Having said that, if the purpose of the nuptial agreement is
to seek to ring-fence future family wealth, it is beneficial
to include as much information as possible about what the
expectation is so that there is a clear record at the point
of signing the agreement as to what the circumstances are
likely to be in the future.
