TRANSPORT ACCIDENT COMPENSATION REFORM.
Consideration was given to the recommendations contained in
Cabinet Minute No. 366-86, dated 1st December, 1986,
submitted jointly by the Deputy Premier, and Minister for
Transport and the Treasurer in relation to this matter.
Cabinet approved of the recommendations of the Policies and
Priorities Committee, as outlined in "Attachment A" to the
Treasurer's letter of 3rd April, 1987, subject to:Medical issues to go before Medical Panels.
All other disputes to District Court, where
a single Judge will be dedicated to
Transcover matters (recommendation 3.1.3.
(xii) and (xiii)).

The Judge will be funded by the Third
Party Fund, as to both salary and
associated expenses.

Weekly benefit to be a maximum of $500
(recommendation 3.1.3. (x) (c)).

Cap on non-pecuniary compensation of
$120,000 (recommendation 3.1.3. (x) (g)).
*
Benefits to minors will not be reduced for
deemed contributory negligence for failure
to wear a seat belt, or where the minor was
a passenger in a car being driven by a
person under the influence of alcohol or drugs
(recommendation 3.1.3. (viii)).

The three year time limit for lodgement of
claims in respect of minors will commence
from the date of their 18th birthday
(recommendation 3.1.3. (ix)).
The Treasurer is to take the necessary action to give effect
to Cabinet's decision, including the preparation of the
necessary legislation.
AMENDMENTS TOTHE MOTOR VEHICLES TAXATION ACT 1980, MOTOR
VEHICLES TAXATION MANAGEMENT ACT 1949, AND THE STATE ROADS
ACT 1986.
Consideration of Cabinet Minute No. 105-87, dated 3rd April,
1987, submitted by the Minister for Roads in relation to this
matter, was deferred until next meeting.
