STATUTORY
DECLARATION.
I EDWARD . JAMES HALLIDAY of Sydney in the State of New South Wales
Solicitor do hereby solemnly and sincerely declare that:
1...r..~I am one of the Executors of the Will of FRANCIS SCALING LOWES late
of Tweed Heads in the State of New South Wales Freeholder deceased.
THE half interest disclosed in the assets referred to in Schedule 4
to the Stamp Affidavit filed in the Estate of the deceased was created
verbally between the deceased and George Goulding on the First day of
November One thousand nine hundred and forty. There was no written
Agreement or any other document executed by the deceased and the said
George Goulding evidencing the creation by them of the said half interests.
IN the year One thousand nine hundred and thirtyeight the deceased
and one, C. E. Cox, purchased two Gaumont British Bioscopes the Purchase
Money being provided by them in equal shares. There was no written
Agreement or other document entered into by the deceased and the said C. E.
Cox relative to the creation of their respective half interests in the
said machines. The half interest of the said C. E. Cox was subsequently
taken over by Border Theatres Limited.
THE deceased was not possessed of any household furniture and effects
other than those disclosed in Schedule 5 to the Stamp Affidavit filed in
All other items of furniture including a Wimiess Receiving
his Estate.
Set, Pianola, Crockery and China are the property of the deceased's widow
and were purchased by her out of the proceeds of the sale of certain Freehold properties which formed part of her separate estate. The only articlE
of Jewellery which the deceased possessed in his lifetime was an old Watch
which he gave to his son Keith Lowes some considerable times before his
death. The said watch is of little value.
ONLY two of the deceased's Freehold properties are rent producing.
The property situated at Wharf Street Tweed Heads is tenanted by P. Osgood
who pays a monthly rental of Six Pounds fourteen shillings and fourpence
(E6.14. 4.) The premises situated at Wharf Street Tweed Heads adjoining
P. Osgood are leased to Border Theatres Limited at a rental of Eight Pounds
six shillings and sevenpence (ES. 6. 7.) per week.
k. THE total income accrued to the deceased as at the date of his death
in respect of his half interest in the Dairy Farm carried on in conjuncticr
with George Goulding is Nine Pounds four shillings (V). 4. 0.) as appears
by the said George Goulding's Statement produced herein.
7. THE whole of the Estate passes to the widow and children of the deceased and in these circumstances it is asked that the filing of a fresh
be dispensed with.
Annexure
8 SINCE the date of grant of Probate of the Will of the deceased the
following additional claims have been received which were due and owing
at the date of his death and which it is desired to include in the
Stamp Affidavit:
