PROPOSED AMENDMENT OF LEGISLATION TO INTRODUCE REVISED
PROCEDURES IN RELATION TO DRIVERS WHO MAv BE AFFECTED BY
ALCOHOL OR OTHER DRUGS.
Approval was given to the recommendations contained in
Cabinet Minute 90-222, dated 24th September, 1990,
submitted by the Deputy Premier, Minister for Public
Works, and Roads, in relation to this matter, subject
to:-
•
there being reasonable grounds for any drug
testing, and test results not being used for
charges involving self-adminstration of a
prohibited drug under the Drug Misuse and
Trafficking Act (Recommendation 3.1a);
consultation between the Minister for Roads and the
Minister for Health as to the definition of an
"appropriately qualified" nurse (Recommendation
3.1b);
consultation between the Attorney General and the
Minister for Roads regarding the perceived
difficulties in the current test for "Driving under
the Influence" as it applies to those taking
regular medication (Recommendation 3.2);
consultation with the Minister for Transport
regarding the consequential amendments to the
Transport Administration Act.

Cabinet also decided that Recommendation 3.2 was to
relate to specified drugs and not all drugs in Appendix
G of the Poisons Regulations.
The Deputy Premier, Minister for Public Works and Roads
is to take the necessary action to give effect to
Cabinet's decision, including the preparation of the
necessary legislation.
