PROPOSED AMENDMENT OF THE LOCAL GOVERNMENT ACT 1919 TO
EMPOWER COUNCILS AND THE NEW SOUTH WALES FIRE BRIGADES
TO ISSUE EMERGENCY CLOSURE ORDERS IN RESPECT OF
BACKPACKERS' HOSTELS.
Approval was given to the recommendations contained in
Cabinet Minute 90-213, dated 13th September, 1990,
submitted by the Minister for Local Government, and
Planning, in relation to this matter, subject to:establishment of an appropriate mechanism for
cross-notification between councils and the Fire
Brigade where orders are issued; and
the Minister for Local Government, and Planning
setting an appropriate penalty for non-compliance
with a Closure order in consultation with the
Attorney General, and during the drafting of the
necessary legislation.

The Minister for Local Government, and Planning is to
take the necessary action to give effect to Cabinet's
decision, including the preparation of the necessary
legislation.

PROPOSED AMENDMENTS TO THE MOTOR ACCIDENTS ACT 1988.
Approval was given to the recommendations contained in
Cabinet Minute 90-181, dated 30th August, 1990,
submitted by the Attorney General, in relation to this
matter, subject to:-

deletion of Recommendation 3.1 (xiii) that s.89(1)
be repealed to facilitate the removal of the Motor
Accidents Authority from the ambit of the
employment provisions of the Public Sector
Management Act;
agreement by the Attorney General and the Motor
Accidents Authority that a standard, machine
readable certificate of insurance acceptable to the
Roads and Traffic Authority be supplied by
insurers; and
agreement between the Motor Accidents Authority and
the Roads and Traffic Authority as to reimbursement
of extra costs incurred by the Roads and Traffic
Authority (provided that these costs can be
satisfactorily demonstrated).
The Attorney General is to take the necessary action to
give effect to Cabinet's decision, including the
preparation of the necessary legislation.
