PROPOSED REPEAL OF THE PUBLIC HEALTH ACT, 1902 AND
ENACTMENT OF A NEW PUBLIC HEALTH ACT, 1990.
Approval was given to the recommendations contained in
Cabinet Minute 90-147, dated 28th June, 1990, submitted
by the Minister for Health, and Arts, in relation to
this matter, subject to:-
•
consultation with the Attorney General and The
Cabinet Office during the drafting of the
legislation on the development of suitable controls
and limits on the exercise of the Minister for
Health's emergency powers, with the Minister to
report back to Cabinet on particular provisions in
the Bill Minute;
withdrawal of recommendations 3. 2. 3(b) (ii) and
3.2.4 (in so far as they apply to public
authorities);
the District Court to hear appeals against public
health orders;
warrants to be required for entry and apprehension
(Attorney General to be consulted in drafting);
consultation with other relevant Ministers during
drafting as agreed to by the Minister for Health in
his responses to Ministerial advices.
The Minister for Health, and Arts is to take the
necessary action to give effect to Cabinet's decision,
including the preparation of the necessary legislation.
