PROPOSED INTRODUCTION OF AN EDUCATION REFORM ACT.
Consideration was given to the proposals contained in
Cabinet Minute 89-364, dated 1st November, 1989,
submitted by the Minister for Education and Youth
Affairs, in relation to this matter.
Cabinet approved of
release of an exposure draft of the Bill, to be
tabled by the Minister for Education and Youth
Affairs;
•
the Minister for Education and Youth Affairs
reporting to Cabinet on the public response to the
draft, prior to final drafting of the Bill;
the Board of Studies adopting the role in relation
to curriculum development outlined in option (a) of
paragraph 25;
the Board of Studies, comprising 15 members, with 4
ex-officio members, some nominated by interest
groups and some Ministerial appointments;
the addition of a clause to introduce the provision
for children absent from school without authority
to be deemed children in need of care, and subject
to proceedings in the Children's Court;
the Minister for Education and Youth Affairs
obtaining Crown Solicitor's advice on the inclusion
of general statements of principle in the proposed
legislation, to ensure that the statements are not
left open to legal challenge.
With respect to closure of an unregistered school,
Cabinet accepted the Minister's submission (paragraph
46) that Government (ie. police) powers not be included
in the legislation.
The Minister for Education and Youth Affairs is to take
the necessary action to give effect to Cabinet's
decision, including the preparation of the necessary
legislation.
