Legislation
There will be some upcoming legislation that
pertains to our Workers9 Compensation beneots.
The orst piece of legislation is SB 808. SB
808 is for oreoghters and orst responders seeking
treatment under the current Heart and Lung Presumption statute. The bill creates an exception to
the usual provider selection process which allows
a oreoghter to give written notice of their selected
physician to the workers9 compensation carrier,
insurer, self-insured provider, or a third-party administrator. That entity MUST then authorize the
oreoghter9s selected physician or schedule an appointment
within ove business days after receipt of the written notice with
an alternate physician for treatment to be held within 30 days
of the written notice. If after 5 days of the written notice an
alternative provider has not been authorized, the oreoghter9s
selected physician is deemed authorized. Treatment will be
reimbursed at no more than 200% of the Medicare rate. This
will go into effect October 1, 2024. This is good news, as we
know how difocult it is currently to get a be seen by a good
cardiologist.
The second piece of legislation is SB 1098, the Employee Organizations Glitch Bill. This bill revises oreoghter
beneots upon a diagnosis of one of the 21 cancers approved

in the cancer bill to include leave and job retention beneots
with the required treatment coverage and one-time payment.
