Appendix B ESEA References to Working with Tribes
TITLE I, PART A – SCHOOLWIDE SCHOOLS
ESEA Section 1114(b)(2) requires all Title I, Part A schoolwide schools to develop their schoolwide plan with
the involvement of tribes and tribal organizations present in the community.
TITLE II, PART A – SUPPORTING EFFECTIVE INSTRUCTION
ESEA Section 2103(a)(2) allows for the development, implementation, and evaluation of Title II, Part A funded
programs and activities to be carried out in partnership with Indian tribes or tribal organizations.
TITLE IV, PART A – STUDENT SUPPORT AND ACADEMIC ENRICHMENT GRANTS
ESEA Section 4106(c)(1) requires that applications for the use of Title IV, Part A funds be developed through
consultation with Indian tribes or tribal organizations located in the region served by the local educational
agency.
TITLE VI, PART A – INDIAN EDUCATION
ESEA Sections 6114(b)&(c) require that:

The LEA will provide assessment results of all Indian children enrolled in the school to the Indian
tribes whose children are served by the local educational agency
Applications for funds will include a description of the process the local educational agency used to
meaningfully collaborate with Indian tribes located in the community in a timely, active, and ongoing
manner in the development of the comprehensive program
Applications for funds will include assurances that the program was developed in open consultation
with parents of Indian children, representatives of Indian tribes, Indian organizations, and Indian
students from secondary schools and that the consultation gave the individuals a full opportunity to
understand the program and to offer recommendations regarding the program
Applications for funds will include an assurance that the local educational agency developed the
program with the participation and wrien approval of a commiee composed of and selected by
parents of Indian children, representatives of Indian tribes, and Indian students aending secondary
schools.
