6.2 (Step 1 only) A Club relegated from the English Football League shall be subject to assessment
for a Licence by the Compe琀椀琀椀on on becoming a member of the Na琀椀onal League in a 琀椀mescale
determined by the Compe琀椀琀椀on and such relegated Club shall fully co-operate with such assessment
in a 琀椀mely manner. Such a Club must not be refused a Licence in its 昀椀rst Membership Year although
any condi琀椀ons for the grant of the Licence must be sa琀椀s昀椀ed by no later than 1 March following the
applica琀椀on.
6.3 (Step 4 only) A Club promoted to the Compe琀椀琀椀on from Step 5 of the Na琀椀onal League System shall be
subject to assessment for the Licence by the Compe琀椀琀椀on on becoming a member of the Compe琀椀琀椀on.
The 琀椀mescale for assessment against the Licence Criteria shall be determined by the Compe琀椀琀椀on
and such a Club shall fully co-operate with the assessment in a 琀椀mely manner. Such a Club must not
be refused a Licence in its 昀椀rst Membership Year although any condi琀椀ons for the grant of the Licence
must be sa琀椀s昀椀ed by no later than 31 March in that Membership Year. The Compe琀椀琀椀on shall no琀椀fy
a Club of the decision in rela琀椀on to a Licence in wri琀椀ng and no琀椀fy The Associa琀椀on at the same 琀椀me.
7. APPEALS
7.1 All decisions of the Compe琀椀琀椀on in rela琀椀on to a Licence shall be subject to appeal only by the Club
which submi琀琀ed an applica琀椀on form for that Licence. The appeal shall be determined in accordance
with The FA’s Appeal Regula琀椀ons save that any such appeal must be lodged in wri琀椀ng within 5 working
days of the date of no琀椀昀椀ca琀椀on of the decision to be appealed against and any appeal hearing must be
held within 14 days of the appeal being lodged with The Associa琀椀on.
7.2 All decisions of The Associa琀椀on where it applies the delegated powers in accordance with Sec琀椀on 2
shall be subject to appeal only by the Compe琀椀琀椀on and the Club which submi琀琀ed an applica琀椀on form
for a Licence. The appeal shall be determined in accordance with The FA’s Appeal Regula琀椀ons save
that it must be lodged in wri琀椀ng within 5 working days of the date of no琀椀昀椀ca琀椀on of the 昀椀nal decision
of The Associa琀椀on to apply delegated powers and any appeal hearing must be held within 14 days of
the appeal being lodged with The Associa琀椀on.
8. RULES AND FA RULES
8.1 The applica琀椀on of the Licence Criteria and processes shall not restrict the applica琀椀on of the Rules
and FA Rules in any way. Any informa琀椀on provided under the licensing processes may be used by the
Compe琀椀琀椀on and or The Associa琀椀on in the applica琀椀on of the Rules and FA Rules respec琀椀vely.
9. MISCONDUCT
9.1 Any Club and or Club O昀케cial that knowingly provides informa琀椀on to the Compe琀椀琀椀on in rela琀椀on to
the Club’s Licence that is found to be false in any par琀椀cular then that Club and or Club O昀케cial may be
charged with Misconduct under the Rules or FA Rules.
LICENCE CRITERIA ANNEX 1
1. LEGAL
1.1 Con昀椀rma琀椀on of the legal en琀椀ty that is the Club
1.1.1 By 14 March in a Membership Year a Club must con昀椀rm to the Compe琀椀琀椀on its company name and
number (if incorporated) and a list of all individuals with a Signi昀椀cant Interest in the Club or the name
of the nominee in whose name the membership of the Company is vested (if an unincorporated
associa琀椀on) as at the 1 March immediately preceding.
1.1.2 The Criteria will be met where the details provided by a Club complies and accords with informa琀椀on
already provided to the Compe琀椀琀椀on.
1.1.3 If a Club fails to provide the informa琀椀on or if the informa琀椀on provided does not comply and accord
to that held by the Compe琀椀琀椀on then the Club must explain any di昀昀erences within a 琀椀mescale set
by the Compe琀椀琀椀on. If the explana琀椀on provided by the Club does not sa琀椀sfy the Compe琀椀琀椀on then
the Compe琀椀琀椀on may refuse the Licence, issue a Condi琀椀onal Licence and or penalise the Club at its
discre琀椀on.
1.2 The Rules or Ar琀椀cles of Associa琀椀on of a Club are required to meet the provisions of Rules 12(a) to (d)
of The Associa琀椀on.
1.2.1 The criteria shall be met where the Club’s ar琀椀cles or Rules meet the requirements of FA Rules I2.1
to I2.4. The Associa琀椀on shall by 14 March in a Membership Year provide the Compe琀椀琀椀on with a
wri琀琀en con昀椀rma琀椀on as to any Club of which it is aware whose ar琀椀cles or Rules do not sa琀椀sfy the
requirements of Rule I2.1 to I2.4 of The Associa琀椀on.
