2. ROLE OF THE ASSOCIATION
2.1 At any 琀椀me The Associa琀椀on can make representa琀椀ons in wri琀椀ng to the Compe琀椀琀椀on with regard to the
Licence of a Club and the Compe琀椀琀椀on shall respond in wri琀椀ng within 5 working days of receipt of the
representa琀椀on.
2.2 The Associa琀椀on has the right to apply at any 琀椀me the delegated powers where in the reasonable
opinion of The Associa琀椀on the Compe琀椀琀椀on has failed to do so or has failed to do so adequately and
the procedure set out in paragraph 2.3 has been followed. This right includes determining any sanc琀椀ons
for non-compliance by a Club with the Licence Criteria. In the event that The Associa琀椀on exercises the
delegated powers then they shall be applied by The Associa琀椀on’s Chief Regulatory O昀케cer or any o昀케cer
ac琀椀ng on a delegated authority.
2.3 The procedure to be adopted in the event that The Associa琀椀on wish to apply delegated powers as
provided for in paragraph 2.2 is that The Associa琀椀on’s Chief Regulatory O昀케cer or any o昀케cer ac琀椀ng on
a delegated authority shall give wri琀琀en no琀椀ce to the Compe琀椀琀椀on se琀�ng out the ma琀琀er in respect of
which it wishes to apply delegated powers, the decision it wishes to apply and the full reasons for this.
The Compe琀椀琀椀on shall reply in wri琀椀ng within 昀椀ve working days of receipt of The Associa琀椀on’s wri琀琀en
no琀椀ce, or 3 May following the submission of the applica琀椀on if earlier, se琀�ng out its responses to the
proposal including the Compe琀椀琀椀on’s agreement or otherwise to The Associa琀椀on’s no琀椀ce. If agreed then
the decision required by The Associa琀椀on shall be applied by the Compe琀椀琀椀on and shall be treated as a
decision of the Compe琀椀琀椀on. If not agreed then The Associa琀椀on may, a昀琀er considering the responses
of the Compe琀椀琀椀on, con昀椀rm its decision to exercise delegated powers to the Club and the Compe琀椀琀椀on
in wri琀椀ng. In the event that The Associa琀椀on has applied the delegated powers then the decision of the
Compe琀椀琀椀on shall be set aside and the decision of The Associa琀椀on shall apply subject to an appeal by the
Club and or the Compe琀椀琀椀on as set out in Sec琀椀on 7.
3. LICENSING PROCESS AND TIMETABLE
3.1 Each Club is required to apply for a Licence using the applica琀椀on form. The applica琀椀on form is to be
received by the Compe琀椀琀椀on by 14 March in respect of the Membership Year immediately following. A
Club shall be assessed by the Compe琀椀琀椀on in accordance with the Licensing Criteria in order to be granted
a Licence.
3.2 The Compe琀椀琀椀on will conclude the assessment process by 21 April of the Membership Year and no琀椀fy
The Associa琀椀on in wri琀椀ng of its licensing decisions by that date in a form reasonably determined by The
Associa琀椀on.
3.3 The Compe琀椀琀椀on must advise each of its member Clubs of its licensing decision in wri琀椀ng on or before
the 5 May following the submission of an applica琀椀on, other than for a Club to which The Associa琀椀on has
exercised the delegated powers in accordance with paragraph 2.3.
3.4 The Compe琀椀琀椀on shall advise The Associa琀椀on in wri琀椀ng of any subsequent decision in rela琀椀on to any
Licence during a Membership Year. Such no琀椀昀椀ca琀椀on to be transmi琀琀ed to The Associa琀椀on within 昀椀ve
working days of the date of the decision of the Compe琀椀琀椀on.
3.5 The Compe琀椀琀椀on may request the a琀琀endance of a Club at a mee琀椀ng to consider the assessment of that
Club in rela琀椀on to the Licence or request any further informa琀椀on it deems appropriate. Such a琀琀endance,
once requested, shall be mandatory and shall be made by an O昀케cer of the relevant Club.
4. LICENCE CRITERIA
4.1 The Licence Criteria are as set out in Annex 1. Each Licence Criterion is to be met for a Club to be granted
an Uncondi琀椀onal Licence. A Condi琀椀onal Licence may be issued as stated in the Licence Criteria.
5. TRANSFER OF A LICENCE
5.1 If a Club wishes to transfer its Licence from one en琀椀ty to another then it may only do so with the wri琀琀en
consent of the Compe琀椀琀椀on and The Associa琀椀on. The requirements to be met for the transfer of a Licence
are set out in Rule 2.9.
6. MOVEMENT OF CLUBS
6.1 In the event that a Club moves from one Compe琀椀琀椀on to another then the Licence will be retained by the
Club and must be applied by the Compe琀椀琀椀on of which that Club becomes a member. The Compe琀椀琀椀on
which receives a Club by such transfer may review that Club’s Licence at any 琀椀me and take such ac琀椀on as
may have been available on the original applica琀椀on.
