8. PROCEDURES FOR THE DETERMINATION OF ANY MATTER, DISPUTE OR DIFFERENCE BY THE
COMMITTEE
8.1 The Commi琀琀ee may adopt such procedures for the determina琀椀on of any ma琀琀er, dispute or di昀昀erence
as it considers appropriate and expedient, having regard to the aims and objec琀椀ves set out at
Regula琀椀on 2. The Commi琀琀ee may require the a琀琀endance at a mee琀椀ng or the wri琀琀en observa琀椀ons of
any League or Club, as it considers appropriate to assist its determina琀椀on.
8.2 (a) Any dispute or di昀昀erence between a League and a Club rela琀椀ng to promo琀椀on and relega琀椀on issues,
lateral movement and/or other eligibility criteria must be referred for determina琀椀on to the Commi琀琀ee;
such determina琀椀on shall be 昀椀nal and binding subject only to Arbitra琀椀on in accordance with Rule K.
(b Subject to Regula琀椀on 6.1 above, any decision of the Commi琀琀ee shall be subject to a right of appeal
to an Appeal Board. The decision of that Appeal Board shall be 昀椀nal and binding on all par琀椀es
All referrals of appeals shall be conducted in accordance with the Appeal Regula琀椀ons save for
(i) appeals in rela琀椀on to Ground Grading decisions where the procedures are outlined in Regula琀椀on
8.2(c) below and (ii) appeals in rela琀椀on to decisions made pursuant to Regula琀椀ons
6.1 and 6.2 above where the procedures are outlined in Regula琀椀on 8.2(d) below.
(c) Procedures for Ground Grading Appeals
(i) The ra琀椀昀椀ca琀椀on of the Ground Grading decision must be sent in wri琀椀ng within 14 days of the 昀椀nal
decision date, currently 31st March.
(ii) Appeals in rela琀椀on to Ground Grading Appeals must be submi琀琀ed to The Associa琀椀on’s Judicial
Services Department within seven days from the date of the wri琀琀en decision outlining the Grounds of
Appeal, with a copy to The Associa琀椀on’s Na琀椀onal League System Department.
(iii) The Commi琀琀ee will appear before an Appeal Board with the Appellant to respond to the
applica琀椀on and there is no requirement to make a formal response in wri琀椀ng.
(iv) In all cases the Commi琀琀ee will submit any documenta琀椀on including the Ground Grading report
that was considered by the Commi琀琀ee in rela琀椀on to the Ground Grading decision, (which the appellant
would already have received).
(v) Dates would be set annually in advance by the Judicial Services Department for the hearing of
Ground Grading appeals and details of the dates would be no琀椀昀椀ed to all Clubs in the correspondence
from the Commi琀琀ee no琀椀fying the decision of the Ground Grading assessment.
(d) Procedures for appeals against decisions made pursuant to Regula琀椀on 6.1 and 6.2
(i) Such appeals must be submi琀琀ed to The Associa琀椀on’s Judicial Services Department within seven
days from the date of the wri琀琀en decision outlining the Grounds of Appeal, with a copy to The
Associa琀椀on’s Na琀椀onal League System Department.
(ii) The Commi琀琀ee’s response to the appeal shall be submi琀琀ed to The Associa琀椀on’s Judicial Services
Department within seven days of the date the Club’s appeal was submi琀琀ed, with a copy to The
Associa琀椀on’s Na琀椀onal League System Department.
(iii) In all cases the Commi琀琀ee will submit any documenta琀椀on considered by the Commi琀琀ee in rela琀椀on
to the relevant decision (which the appellant would already have received) with its response.
(iv) The Commi琀琀ee will appear before an Appeal Board with the Appellant for determina琀椀on of the
appeal.
(v) Dates would be set annually in advance by the Judicial Services Department for the hearing of
such appeals and details of the dates would be no琀椀昀椀ed to the Club in the correspondence from the
Commi琀琀ee no琀椀fying them of the relevant decision.
8.3 The Commi琀琀ee may, at its discre琀椀on, delegate the resolu琀椀on of any ma琀琀er, dispute or di昀昀erence
arising under these Regula琀椀ons to anybody it considers to be appropriate (including a sub- commi琀琀ee
or commission which may include members of council not on the Commi琀琀ee or a body cons琀椀tuted by
a County Football Associa琀椀on).
9. CRITERIA FOR THE PARTICIPATION IN PLAY OFF AND INTER STEP PLAY OFF MATCHES
In order to qualify for Play O昀昀 Matches a Club must comply with:
Security of Tenure – see Standardised Rule 2.3.2
Solvency – see Standardised Rule 13.B.2
Ground Share requirements, i.e. not ground share in order to gain promo琀椀on – see 5.7 of these
Regula琀椀ons
Ground Grading – see 5.8 of these regula琀椀ons and the relevant criteria document
10. ARBITRATION
The fact of par琀椀cipa琀椀on in the NLS and signifying agreement to be bound by the Regula琀椀ons shall
cons琀椀tute an agreement between each League and Club to refer to Arbitra琀椀on any challenge in law
arising out of, or in rela琀椀on to, the Regula琀椀ons in accordance with the provisions of FA Rule K.
