08 Standardised Rules33. Each Club shall at all 琀椀mes comply with all reasonable requests by the Compe琀椀琀椀on to ensure duecompliance by the Compe琀椀琀椀on with its Commercial Agreements and shall not enter into any newagreements with any direct compe琀椀tor to the Compe琀椀琀椀on’s 琀椀tle sponsor or any third party withwhom the Compe琀椀琀椀on has entered into a commercial agreement.34. Each Club must u琀椀lise any match boards provided by the Compe琀椀琀椀on’s sponsor and must procurethat any bench kit provided by a sponsor shall be worn during compe琀椀琀椀ve and 昀椀rst team matches. Inthe event that a Compe琀椀琀椀on does not have a bench kit sponsor, a Club may enter into its own benchkit sponsor agreement providing any such agreement is in wri琀椀ng and the Club obtains the consentof the Compe琀椀琀椀on in wri琀椀ng before entering into such agreement which must include a breakclause which facilitates ending the agreement if the Club is promoted, relegated or laterally movedto another compe琀椀琀椀on, or the Compe琀椀琀椀on nego琀椀ates a new agreement in the future. A full copy ofsuch agreement must be provided to the Compe琀椀琀椀on Secretary within 昀椀ve (5) days of the sending ofsuch request by the Compe琀椀琀椀on.In the event of any Club having an exis琀椀ng agreement with a compe琀椀tor to any of the to theCompe琀椀琀椀on’s sponsors in respect of match boards and/or other commercial or adver琀椀singobliga琀椀ons, the Club is permi琀琀ed to honour that agreement on an on-going basis, with the consentof the Compe琀椀琀椀on provided the Club’s agreement was signed before that of the Compe琀椀琀椀on and afull copy of any such agreement must be provided to the Compe琀椀琀椀on Secretary within 昀椀ve (5) daysof the sending of such request by the Compe琀椀琀椀on. For the avoidance of doubt, the Club would notbe permi琀琀ed to extend said agreement beyond the exis琀椀ng term.35. Each Club shall permit photography, 昀椀lming and audio and web broadcas琀椀ng at their home groundto enable the Compe琀椀琀椀on to comply with the terms of any Commercial Contract (as de昀椀ned inthe Ar琀椀cles), which may be entered into by the Company and will provide all necessary facili琀椀es asmay reasonably be requested by the Compe琀椀琀椀on or any broadcaster as may be nominated by theCompe琀椀琀椀on. Appendix F.36. Not applicable37. The Company shall be en琀椀tled either directly or through its duly appointed agents to inspect thebooks, accounts and 昀椀nancial records of any Club and that Club shall make available to the Companyall informa琀椀on as may be required from 琀椀me to 琀椀me in that respect.38. CLUB FINANCE RECORDS. Na琀椀onal League Only.39. CENTRAL FUNDING. Na琀椀onal League Only.40. FINANCIAL REPORTING INITIATIVEA club shall comply with the provisions of Appendix D ‘Financial Repor琀椀ng Ini琀椀a琀椀ve’ as shall beenforced from 琀椀me to 琀椀me as determined by the Board and approved by the Football Associa琀椀on.41. BUDGET MONITORING SCHEME & PERMITTED LOANS – Na琀椀onal League Only42. An Embargo may be imposed pursuant to any of the relevant preceding or subsequent Rules andRegula琀椀ons or Appendices but in any event shall be imposed:• where a Club has undergone an Insolvency Event• where a Club has been served with a winding-up pe琀椀琀椀on which has not been sa琀椀s昀椀ed in full or tothe sa琀椀sfac琀椀on of the pe琀椀琀椀oning creditors as evidenced by wri琀琀en agreement or• where a Club has either defaulted on such an agreement or has omi琀琀ed or incorrectly reported itsfailure to adhere to the terms of any agreement.Any Embargo is without prejudice to any other penal琀椀es that the Compe琀椀琀椀on may wish or been琀椀tled to impose pursuant to any other Rule or Regula琀椀on or Appendix in rela琀椀on to any ma琀琀ergiving rise to the right to impose an Embargo including but not limited to any default, or anyagreement reached with creditors or failure to report the default or incorrectly repor琀椀ng the Club’sadherence to any agreement with creditors.The following appendices are incorporated within the membership rules and should be read inconjunc琀椀on with the aforemen琀椀oned rules.
