The NYS CERTIFICATE of NEED (CON): Do Not Fear
Article 28 is a New York State Public Health Law that recognizes and regulates the
accreditation of public healthcare facilities. These facilities include hospitals,
nursing homes, and diagnostic and treatment centers. All Article 28 construction
projects need CON approval from the Department of Health (DOH), CON council,
or other state agency.
The objectives of the CON process are to promote the delivery of high‐quality
health care and ensure that services are aligned with community needs. CON
provides the Department of Health oversight in limiting investment in duplicate
beds, services, and medical equipment, limiting associated healthcare costs.

In our 30 years of working in the NYS healthcare field, with most of our
work being for Article 28 clients, the CON process seems to strike FEAR in
some of our clients. However, we in the architectural field need to
remember that the goal of the CON approval agencies is just that –
approving CON submissions in a timely and cost‐effective manner to promote the
delivery of high‐quality health care and ensure that services are aligned with community
needs.
