Litigation has been linked to profound negative
physical and psychological consequences for both
plaintiffs and defendants. Consequences include
insomnia, anger, frustration, humiliation, headaches,
difficulty concentrating, loss of confidence, indecision,
anxiety and despondency. This is a clinical presentation that has much in common with the symptoms of
posttraumatic stress disorder (PTSD).
Using guidelines set out by The National Institute for
Health and Care Excellence (NICE) guidelines, a public body, sponsored by the Department of Health and
Social Care to provide national guidance to improve
health and social care, clinical psychologists recommend and direct individuals to evidence based treatments that will; prevent ill health, promote and
protect good health, improve the quality of care and
services, adapt and provide health and social care
services.
• The likelihood of repeat offending
There are several factors that have been demonstrated
to reduce the possibility of reoffending, these include,
prosocial social networks, activities that increase an
individual’s sense of agency, self-efficacy and good
problem-solving skills.
A clinical psychologist’s training, grounding in evidence-based practice and experience working with individuals across the life span places them in the unique
position to understand the different causes and mechanisms involved in any situation and the need to consider the multifactorial links between cause and effect.
Such an approach allows them to support the legal
process of assessing an individual’s situation and finding a helpful, appropriate, and accessible pathway
through challenges.
