A claimant must be able to clearly demonstrate
causation and a clear link between the defendant’s actions and their psychological harm, in many cases relying on expert testimony from psychiatrists/
psychologists. Expert witnesses are vital in cases involving mental health claims as, unlike physical injuries, it can sometimes be impossible for a lay person
to judge how affected a claimant may be. To qualify
for compensation, the mental health condition must
meet the threshold of a recognized psychiatric illness.
