Expert Witness Journal
Hello and welcome to our December issue, we would like to wish all our experts and readers a
happy holidays.
Last month saw the Bond Solon Expert Witness Conference at Church House, London.
It was great to meet so many experts old and new, representing over 80 areas of expertise.
We always look forward to meeting experts ‘face to face’, to hear the diverse and interesting talks
gaining a valuable insight into the thoughts and developments of experts.
The main focus of this issue is psychiatry, psychology and capacity, with excellent articles on
‘Determining Capacity to Litigate in Civil Proceedings’ by Holly Tibbitts. ‘Functional Cognitive
Disorder (FCD) in Personal Injury’ by Dr Tracey Ryan-Morgan & Yasmin Hiscox at Talis
Consulting Limited. A ‘Neuropsychologist's Role in Sentencing’ by Dr Marzio Ascione.
‘Keeping Expert Reports on Track to Enhance Litigation Outcomes’ reflections by Circle Expert
Service on how their past helps them to improve the future.
In this issue we also feature ‘Year in Review, Lack of Capacity/Knowledge and Approval’, by
Daniel Edwards, Partner at Browne Jacobson. Also The Beginnings of a Test For Substantial
Injustice? Where Section 57 of the Criminal Justice and Courts Act 2015, which compels the
Court to dismiss a claim, even though the claimant would be entitled to damages, where the
Court is satisfied that it is fundamentally dishonest. Also ‘Emotional Bankruptcy: How Fraud
Victims Lose More Than Just Their Money,’ by Daniel Sibthorpe, Senior Manager, Forensic
Services, Crowe UK.
Our congratulations to Somek & Associates who are a leading Expert Witness Consultancy
