Welcome to the
Expert Witness Journal
In this issue we mostly cover personal injury. A personal injury claim has been described as ‘a legal
case where one party has suffered injury in an accident and it was someone else's fault’. Although
anybody who has been involved in a PI case will know its a lot more complicated.
Areas covered include, ‘An Unhelpfully Catastrophic Contribution’ by Ben Simons. Where in the
early stages of a personal injury claim, particularly road traffic accident (RTA) claims, whilst the
insurers are investigating liability, they will often allege that the claimant has contributed in some
way to the accident occurring.
‘Whiplash Reform and the Official Injury Claim service’, A House of Commons Committee
report, with recommendations to government, gives indepth details of the major reforms to the
area of compensation for whiplash.
‘Tackling Health and Safety in Sport’, Kevin Clancy and Yaser Razouk explore the ongoing
practical and legal challenges faced by sporting governing bodies and individuals alike regarding
concussion management. ‘Role of MRI or CT Scan in Sports Head Injury’ by Nader
Khandanpour.
‘Gross Negligence Manslaughter and the Medical Profession. Is the Test Fit for Purpose?
Is a New Approach Needed?’ Article two of three by Rakesh Bhardwaj.
Of interest to all instructors and experts are ‘Expert Report Writing Part Three: The Quantum
Report’ by Hugh Johnson. And‘Corporate Fraud. Any ‘Collar’ You Like!’ A case for asserting that
the term ‘white-collar crime’ is out of date and confusing for executives, lawyers, and managers,
by Ian Ross.
Our next issue will be published in August 2024, if you have a submission or article email us.
